What Are You Doing About……?

“Bombshells” regarding the state of election integrity across the nation are exploding on a daily basis. Some go basically un-noticed. But others cause an enormous stir.
When they do, Election Integrity Project®California (EIPCa), an ALL-volunteer organization (including the founders, the Board, the researchers, and the Coordination teams) receive a flurry of calls, emails and website messages asking (some politely inquisitive and some clearly belligerent and hostile) “What are you doing/going to do about…?"
One day, one segment of the population suddenly becomes aware that the voter rolls are in various stages of disarray, and that such a situation just might impact the integrity of electoral results. Later, that awareness comes to a different segment, and the “surprise” multiplies. And the questions pour in.
What is EIPCa doing about that situation?
We filed (April, 2017) and prevailed (January, 2019) in a lawsuit that resulted in the removal of 1.5 million obsolete registrations from the Los Angeles County voter rolls, and the moving of another 1.5 million from active to inactive status in preparation for their ultimate removal.
In addition, that lawsuit resulted in the Secretary of State’s (SOS) revising the instruction manual for voter roll maintenance to become aligned with federal law. The SOS conducted in-service training for the elections officials in all 58 counties.
Did that solve the problem? No. But it was a good start, a huge win for the people of California.
The importance of Cast Vote Records (CVRs) has risen to public awareness recently. Everyone is eager to request them, though few seem to have any idea what to do with them once they get them. Their usefulness is in determining who voted unlawfully, or twice, or from the grave, and how many “ghost” votes there may have been.
- To analyze the records for that information, one needs access to other databases, such as the National Change of Address database, and the Social Security Death Index, among others.
- One also needs qualified, trained and experienced programmers and analysts to ferret out the irregularities in a reliable fashion.
- Some of the people calling or emailing are demanding that EIPCa either do this work FOR them or teach them how to do it.
This is NOT possible due to the time constraints of EIPCa’s current workload.
Federal and state laws require retention of all election-related materials for 22 months after each federal election to be available in the event there is a successful audit mandated, or a lawsuit filed.
Assuming there are actionable results from the analysis of the CVRs, one needs an attorney willing and able to pursue a lawsuit, and the money to support it (not to mention a receptive District Attorney and a courageous judiciary).
Only if such a suit or audit is imminent will an injunction prohibiting the scheduled destruction of the records from a previous election be granted.
What is EIPCa doing about that situation?
EIPCa’s Data Analysis Group (DAG) has obtained the CVRs for California every election since 2012, professionally analyzed the data, created Findings Reports and shared them with local and state elections officials as well as with the public at large through media alerts and website postings.
In January 2021 EIPCa filed a lawsuit challenging the Constitutionality of California’s election laws, emergency regulation, county policies & procedures. In light of our federal lawsuit, EIPCa filed and obtained protective orders for 2020 and 2021 materials in the 13 counties named in the suit. We also filed a protective order for Kern County for 2021materials.
The work everyone is suddenly clamoring for in California has been done by dedicated EIPCa volunteers in 14 counties which represent ALL of the largest counties.
Since those counties represent all of the issues in the state, the results of their audits and of the lawsuit as a whole will bring relief to all of the counties in the state.
The most recent furor and election integrity concern regards the “machines” - any election technology used to generate, cast or count ballots.
The concern is well founded, and calls to action abound. And EIPCa again gets deluged with the question, “What are you doing/going to do?”
EIPCa’s 2021 federal lawsuit is a comprehensive Constitutional challenge of 20+ California election laws, plus procedures, regulations and (yes) the “machines”.
This lawsuit, currently awaiting oral arguments before the Ninth Circuit Court of Appeals (September 23, 9:30 a.m.), challenges the constitutionality of 20+ California election laws. It also challenges the constitutionality of current policies and procedures both county and state-wide.
AND it demands a forensic audit of all “machine” software and hardware to determine vulnerabilities and actual manipulative use, as well as the materials used for vote by mail voting.
We expect to win this suit, albeit probably at the Supreme Court level, and when we do, the unconstitutional laws, policies and procedures, and the “machines” (if determined to be compromised or vulnerable to compromise) will be struck down within the entire jurisdiction of the court that makes the ruling. California, and perhaps the entire nation, will be forced to institute new electoral processes that maintain constitutionality and integrity.
THAT is what EIPCa is “doing/going to do”.
Ours is an effort that spans 12 years of slow and steady documentation with the help of tens of thousands of citizen volunteers.
At last, our time has come. We have the “goods” and are bringing them to bear.
