Are Election Officials Writing Policies that Supersede Law?

EIPCa fully embraces not only our right but our obligation to OBSERVE every aspect of the electoral process, guaranteed to us by California law. Due to the overwhelming preponderance of vote-by-mail, provisional and conditional ballots submitted, it is vital that citizens oversee their processing, including signature verification and duplicating. Only then can we assure voters that a) every vote is cast lawfully, and b) every lawful vote is accurately counted.

Because there is no leadership from the Secretary of State with regard to policies and procedures that interpret the citizens' right to observe, each county's Registrar's office creates its own. Some variation is understandable and expected, but the basic right to observe, meaning to be close enough to see and hear that proper procedures are being followed, is codified in California law.

The action described in the following article seeks a court judgment clarifying that elections officials do not have the authority to write policies and procedures that supersede California Election law, which we allege has happened in Ventura County, as well as several other California counties. A positive outcome to this case will ensure that EIPCa observers and all California citizens will be fully afforded their legal right of legitimate observation in every county.

VENTURA-A lawsuit was filed by Election Integrity Project California and City of Oxnard plaintiff Rolando Chinea in Superior Court Friday, March 6th claiming that the Ventura County Office of Clerk and Recorder was not allowing voter transparency in the March 3, 2020 Primary Elections.
