Judge Dismisses EIPCa Federal Lawsuit:
What does it mean?

 

Many of you have been following the two lawsuits filed by EIPCa to challenge the unconstitutional elections laws, regulations, policies and procedures used to manage elections and process ballots in California elections.

 

On July 18, 2023 California Judge André Birotte Jr. dismissed EIPCa’s federal lawsuit for the second time.

 

EIPCa sent our attorney’s latest press release to everyone last week, responding to the second dismissal. This resulted in many of you wanting to know what it all means.

 

Below is a synopsis of the press release that will help explain what this ruling means.

 

In spite of the fact that:

 

 

  • and as of August 7, 2023 Discovery has not yet been allowed to begin and NONE of the EIPCa evidence has been presented in court,

 

Judge Birotte dismissed the EIPCa lawsuit, claiming EIPCa’s allegations amounted to garden-variety” election irregularities.  

 

What does this mean?

  • unremarkable
  • usual

 

Our attorney Mariah Gondeiro made these points in her response:  

 

  • The allegations do not amount to garden-variety election irregularities.”

 

  • EIPCa allegations represent systemic issues with California’s election process that disproportionately harm valid in-person voters.” 

 

  • “These irregularities are the result of California’s laws and regulations that massively expanded universal vote-by-mail and gutted signature verification requirements.”

 

Attorney Gondeiro with Advocates for Faith and Freedom will appeal this ruling on behalf of Election Integrity Project®California.

 

  • Robert Tyler, President for Advocates for Faith and Freedom said, “We look forward to winning again at the Ninth Circuit and setting precedent that will have a broader impact.”

 

This type of challenge is not new to Election Integrity Project®California (EIPCa).

 

Before we formed the nonprofit Election Integrity Project®California in 2017 we founded the for-profit Election Integrity Project (EIP) in December 2010.

 

  • After working hard to build teams across the state of California, Election Integrity Project (EIP) trained 2400 volunteers in 40 counties (representing approximately 85% of the CA population).

 

  • The result was that 2100 trained individuals went to the polls in their counties to observe and document how the election process was being implemented.

 

  • The Incident Reports, signed under penalty of perjury, showed a serious breakdown in the integrity of the election process.

 

  • The reports resulted in a Findings Report that should have been used to correct the weaknesses in the system.

 

  • No action was taken so we turned the report into a White Paper and made it public to alert the citizens of California and everyone else interested in restoring integrity.

 

The 2012 volunteers who worked so hard observing and documenting the FIRST EVER statewide (40 out of 58 counties) election process in California were shocked and discouraged when….

 

…. the Registrar of Voters and the Secretary of State did not address the issues provided in the Findings Report.

We can only be destroyed from within if we don’t have a strategy to win. This is not the time to faint from despair or rage and lose sight of our goal.

 

We must keep our heads about us, follow the strategy that was implemented in the calm before the storm, and be intent that the hysteria of the masses will not pull us from our determination to bring justice to a corrupt system.

 

We will not falter in our goal to shed light

on what truly happened on November 6, 2020.

 

It will be great patriots like you and those who fought the good fight to now educate people in your circles of influence about the truth of the Progressive plans for our demise.

 

Minds are being changed; now we must show them the proof that Californians no longer have a voice in government when the election process has been so diluted as to allow no real assurance that the process is fair and honest.

 

 

Election Integrity Project®California and Advocates for Faith and Freedom will continue to fight to bring EIPCa’s evidence before the courts.
