The Consent of the Governed is the Basis of Government Authority

 

 

"Consent of the governed," a phrase found in the United States Declaration of Independence, refers to the concept that a government's legitimacy and moral right to use State power is only justified and legal when the people consent to the exercise of that political power.

 

The founders of the United States believed in a government built upon the consent of "free and equal" citizens.

 

A State otherwise conceived would lack legitimacy and legal authority.

 

From the Declaration of Independence:

We hold these truths to be self-evident, that all Men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.

 

That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed…

 

The consent of the governed begins with a

fair, honest and transparent election process.

 

Election Integrity Project®California, Inc. (EIPCa) is a California nonpartisan non-profit public benefit corporation committed to defending the civil rights of U.S. citizens to fully participate in the election process including legal action when necessary.

 

EIPCa has filed three lawsuits so far:

  1. 2017 – EIPCa v Padilla & Logan (state court) re: violation of NVRA Sect. 8 (voter rolls) - settled in EIPCa’s favor in January of 2019.

 

  1. 2020 – EIPCa, Rolando Chinea v Lunn (state court) re: observer rights - heard in court in June 12, 2023 (see below)

 

  1. 2021 – EIPCa v Weber, Bonta, 15 CA ROVs (federal court) re: unconstitutional election laws, regulations, policies & procedures - cleared to proceed after the Ninth Circuit Court of Appeals ruled that EIPCa does have standing in this matter.

 

EIPCa & Rolano Chinea sued Ventura County Registrar Mark Lunn in CA state court in 2020 for violation Election Code §15104 that gives authority to citizens to observe the entire vote-by-mail election process, ask questions, receive answers and present challenges.

 

Originally scheduled for hearing in March, 2020, our day in court was delayed over three years due to the ramifications of the court closures due to COVID.

 

Finally, our case went to trial on June 12, 2023

and concluded on June 16, 2023.

 

For five grueling days EIPCa Ventura volunteers testified in support of their documentation of the county’s noncompliance with EC §15104 resulting in almost NO transparency of the procedures used to process vote by mail ballots. A member of the EIPCa Board also testified in support of the integrity of our company and the intense training of our volunteers.

 

Due to the huge amount of evidence and testimony, the judge scheduled July 10th for the attorneys to come back to court for closing arguments.

Latest Developments: Election Integrity Case

 

Our team has been engaged in a monumental case, and we wanted to share with you the latest update. Last week, over the course of five intense days, we passionately represented our clients, Election Integrity Project®California (EIPCa), in trial.

 

Our primary objective is to ensure election integrity and promote transparency within our voting system.

 

The testimony presented was comprehensive and compelling, thanks to the exceptional work of our attorneys.
