Filed an Appeal with the 9th Circuit to begin Discovery


Election Integrity Project®California (EIPCa) filed a lawsuit to challenge the unconstitutional elections laws, regulations, policies and procedures used to manage elections and process ballots in California elections.

 

On July 18, 2023 California Judge André Birotte Jr. dismissed EIPCa’s federal lawsuit for the second time claiming EIPCa’s allegations amounted to garden-variety” election irregularities.

Filed an Appeal with the 9th Circuit to begin Discovery

 

Robert Tyler, President for Advocates for Faith and Freedom said, “We look forward to winning again at the Ninth Circuit and setting precedent that will have a broader impact.”

 

Mariah Gondeiro, EIPCa attorney with Advocates for Faith and Freedom said Judge Birotte dismissed the case, in spite of the fact that:

 

  • the 9th Circuit Court of Appeals previously ruled that EIPCa has standing and ordered our case to go back to the lower federal court to begin Discovery.

 

  • as of August 7, 2023 Discovery has not yet been allowed to begin.

 

  • NONE of EIPCa evidence has been presented in court.

 

 Attorney Mariah Gondeiro disagreed with Judge Birotte’s assertion stating:

 

  • The allegations do not amount to garden-variety election irregularities.”

     

  • EIPCa allegations represent systemic issues with California’s election process that disproportionately harm valid in-person voters.” 

     

  • “These irregularities are the result of California’s laws and regulations that massively expanded universal vote-by-mail and gutted signature verification requirements.”
